Our website is www.betterguts.com which is operated by Strain Supplements Ltd, a company registered in England and Wales. Throughout this policy we refer to ‘we’ or ‘our’, which means Strain Supplements Ltd. Strain Supplements Ltd’s company registration number is 16459646 and the company’s registered offices are at Lytchett House, 13 Freeland Park, Wareham Road, Poole, Dorset, BH166FA. The registered VAT number for the company is 497 0641 61.

3. Other terms
3.1 There are other terms that may apply to you. These terms of use refer to the following additional terms, which also apply to your use of our site:
(i) Our privacy policy, set out by Shopify.
3.2 Purchasing our products. If you purchase products from our site, our will apply to the sales, as will our Returns and Refunds policy, our Cancellations policy, and our Shipping policy.
4. Our site
4.1 We may make changes to our site. We may update and change our site from time to time to reflect changes to our products, our users' needs and our business priorities or legal obligations under UK law.
4.2 We may suspend or withdraw our site. Our site is made available free of charge. We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.
4.3 This is a UK website. Our site is mainly directed to people residing in the United Kingdom and it is governed by the law of England and Wales. However, it is also accessible internationally, however we only ship our products domestically within the UK. 5.2 Right to disable. 6.1 Two different sections to the site. Please be aware that this site is categorised into two individual and distinct sections:
(i) the primary BetterGuts section; (ii) the Learn hub, and
These different sections of the site have different intended audiences and access restrictions. The primary BetterGuts section is intended for consumers to purchase our products and any sales are subject to the and all relevant policies as set out in 3.2
The Learn hub is intended for members of the public as a non-commercial, open educational resource. This section is intended for education only, citing various studies conducted by organisations in no way affiliated with BetterGuts or Strain Supplements Ltd, and should not be taken as a promise to treat, cure, or alleviate the symptoms of any disease with our products, nor should it be used to diagnose any medical issues/conditions. Always consult a medical professional before taking supplements, especially if taking them alongside existing medication or medical conditions.
Searches made in any of the two sections will return relevant results from both sections, and your departure from one section to another will be made obvious by the difference in appearance between the two sections. These Terms and Conditions apply to both sections and this site as a whole.
6.2 How you may use material on our site. We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

7.4 Right to revoke. We reserve the right to withdraw linking permission without notice and to take any action we deem appropriate. You shall fully indemnify us for any loss or damage we or any of our group companies may suffer or incur as a result of your breach of clause 7.2.
8. Our responsibility for loss or damage suffered by you
8.1 Liability limitations. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation. Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any products to you, which will be set out in our .
8.2 If you are a consumer user. Please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. We will only use your personal information as set out in our .
9. User-generated content
9.1 Content Standards. These content standards apply to any and all material which you contribute to our site. This site may include information and materials written in the form of reviews (Contributions) written by visitors to our site and purchasers of our products. This clause must be complied with in spirit as well as to the letter. The standards apply to each part of any Contribution as well as to its whole. We will determine, in our discretion, whether a Contribution breaches this clause.
A Contribution must not: (i) Be defamatory of any person, bully, insult, intimidate or humiliate, be obscene, offensive, hateful or inflammatory. (ii) Be likely to deceive any person. (iii) Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence. (iv) Impersonate any person, or misrepresent your identity or affiliation with any person. 9.2 Posting contributions. In providing or posting any Contribution to this site, you must ensure that your Contribution:
(i) is accurate (where it states facts); (ii) is genuinely held (where it states opinions); (iii) is not likely to deceive any person; (iv) does not impersonate any person, or misrepresent your affiliation with any person; (v) does not reference use of our supplements for treating or diagnosing any medical conditions; (vi) complies with the content standards in clause 9.1; and (vii) complies with the law applicable in England and Wales and in any country from which it is posted.
9.3 Warranty. You warrant that any Contribution complies with clause upon making that contribution.
9.4 You will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
9.5 Contribution moderation. Contributions will be checked by us to ensure compliance with our regulators. The views expressed are those held by the author and do not necessarily represent our views or values.
9.6 Disclosure and removal. We have the right to disclose your identity to any third party who is claiming that any Contribution posted to our site constitutes a violation of their intellectual property rights, or of their right to privacy. We have the right to remove any Contribution you make on our site if, in our opinion, your Contribution does not comply with the content standards set out in clause 9.1.

(i) any material you provide, including the content of any reviews, will be considered non-confidential and non-proprietary; (ii) we and our nominees will be free to copy, disclose, distribute and use such material for any and all commercial or non-commercial purposes. Without limiting our rights under these terms, we are under no obligation to publish any Contribution you post to this site and we may edit any material you provide in order to comply with our legal and regulatory obligations (this may include editing content in order to ensure that no medical advice nor reference to medical conditions, which could be construed as medical claims, are hosted on the site).
9.9 Distribution of user-generated material. Other than personally identifiable information, which is covered under the , any material you transmit or post to our site, including the content of any reviews, will be considered non-confidential and non-proprietary. Without limiting our rights under these terms, we are under no obligation to publish any material you transmit or post to our site and we may edit any material you transmit or post to our site in order to comply with our legal obligations (this may include removing content in order to ensure that no medical advice nor reference to medical conditions - which could be construed as medical claims - are hosted on the website).
10. Ensuring site security
10.1 Security. We make all reasonable efforts to maintain our site but we do not guarantee that our site will be completely secure. You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.
10.2 Do not misuse our site. You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
11. Breach of this policy
When we consider that a breach of these Terms has occurred, we may take such action as we deem appropriate and may result in our taking all or any of the following actions:
(i) Immediate, temporary or permanent withdrawal of your right to use our site or any Contribution made. (ii) Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.

12.1 Disclosure. Disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law will be exercised. We exclude our liability for all action we may take in response to breaches of this acceptable use policy. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.

13.1 Our trademarks are registered. The trademark registered under number UK00004274336 with the Intellectual Property Office, BetterGuts (figurative), is the registered property of Strain Supplements Ltd. It may not be used, reproduced or copied without our express written approval.
The trademarks BB-12™ and LGG™, and associated logos, are the registered trademarks of Chr Hansen Uk Ltd and the Novoensis group. You are not permitted to use them or reproduce them in any capacity without the written consent of Novoensis group or Chr Hansen UK Ltd.
13.2 If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
13.3 Governing Law. This agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.
